HERITAGE HANDOVER LLC — CLIENT SERVICE AGREEMENT & LIABILITY WAIVER
1. Equipment & Materials. Heritage Handover LLC uses professional sheet-fed scanning equipment (Canon imageFORMULA RS40). Every precaution is taken to handle materials with care; however, the Client acknowledges that aged photographs, albums, and documents may be fragile, and Heritage Handover LLC is not liable for incidental damage to deteriorated materials during the scanning process. Certain materials cannot be processed through our roller-feed scanner and will be returned as-is — including scrapbooks, items with loose fabric, and dimensional elements such as wedding invitations or greeting cards with attachments. Please discuss any non-standard materials with us prior to pickup.
2. Adhesive & Bound Materials. For photos adhered to album pages, Heritage Handover LLC will make reasonable attempts to separate materials safely. This process carries a risk of damage, and Heritage Handover LLC is not liable for damage resulting from the separation of adhered materials. A $20 per album fee applies. The Client acknowledges that photo albums submitted for scanning may be destroyed in the process of extracting the photographs — albums should be considered non-returnable, and photos will not be re-inserted after scanning. Originals are returned loose in the same transport bins used for pickup.
3. Limitation of Liability. In the event of hardware failure, data loss, or accidental damage, Heritage Handover LLC's total liability is strictly limited to the cost of the scanning service paid by the Client. No sentimental value, replacement value, or consequential damages are implied or guaranteed.
4. Ownership & Rights. The Client confirms they are the legal owner of all submitted materials, or have explicit permission to have them digitized. Heritage Handover LLC makes no claim of ownership over the Client's original photographs or their digital reproductions.
5. Prohibited Materials. The Client confirms that all submitted materials are legal to possess and reproduce under applicable law. Heritage Handover LLC reserves the right to stop processing, return, or decline any materials that appear to contain illegal content. Materials discovered to contain child sexual abuse material (CSAM) or evidence of serious criminal activity will be reported to the appropriate authorities, including the NCMEC CyberTipline and/or local law enforcement. Heritage Handover LLC is not liable for the content of materials submitted by the Client.
6. Digital Gallery & Data Retention. The Client's private gallery will remain accessible for 90 days following project completion and final payment. Reminder emails are sent at 60 and 80 days before expiry. After 90 days, online access is closed. Heritage Handover LLC retains the right to archive scans on secure local storage for business continuity purposes. The Client may request permanent deletion of their scans at any time by contacting lab@heritagehandover.com.
7. Minimum Service Fee. The Client acknowledges a minimum project fee of $250, regardless of final photo count. The $25 booking deposit is applied toward this total.
8. Unclaimed Originals. If the Client does not respond to schedule delivery within 60 days of notification, original physical materials will be considered abandoned and may be disposed of at Heritage Handover LLC's discretion.
9. Electronic Signature. The Client agrees that an electronic signature on this document is legally binding and equivalent to a handwritten signature.
