HERITAGE HANDOVER LLC — CLIENT SERVICE AGREEMENT & LIABILITY WAIVER
1. Scanning Equipment & Process. Heritage Handover LLC uses professional flatbed and sheet-fed scanning equipment (Canon imageFORMULA RS40). Every precaution is taken to handle materials with care. However, the Client acknowledges that aged physical media — including but not limited to photographs, albums, slides, and documents — may be fragile. Heritage Handover LLC is not liable for inherent degradation or incidental damage to aged or deteriorated materials during the scanning process.
2. Adhesive & Bound Materials. For photos adhered to album pages or otherwise stuck together, Heritage Handover LLC will make reasonable attempts to separate materials safely. The Client acknowledges that this process carries a risk of damage and that Heritage Handover LLC is not liable for damage resulting from the separation of adhered materials. A $20 per album fee applies for this labor-intensive service.
3. Limitation of Liability. In the event of hardware failure, data loss, or accidental damage, Heritage Handover LLC's total liability is strictly limited to the cost of the scanning service paid by the Client. No sentimental value, replacement value, or consequential damages for original or digital media are implied or guaranteed.
4. Client Ownership & Rights. The Client confirms they are the legal owner of all submitted materials, or have explicit permission from the owner to have them digitized. Heritage Handover LLC makes no claim of ownership over the Client's original photographs or their digital reproductions.
5. Digital Archive & Data Retention. The Client's private digital gallery will remain accessible for 90 days following project completion and final payment. Heritage Handover LLC retains the right to archive digitized scans on secure local storage indefinitely for business continuity purposes. The Client may request permanent deletion of their scans at any time by contacting lab@heritagehandover.com.
6. Anonymized Data & Future Use. Heritage Handover LLC reserves the right to use anonymized scan data (with all identifying metadata, names, and personal information removed) for potential future purposes, including but not limited to AI/ML training data licensing. Heritage Handover LLC commits to notifying clients if their anonymized scans are ever sold or licensed to a third party. Clients may opt out by written request to lab@heritagehandover.com.
7. Minimum Service Fee. The Client acknowledges a minimum project fee of $250, regardless of final photo count. The $25 booking deposit is applied toward this total.
8. Unclaimed Materials. Original physical materials not collected within 60 days of delivery notification will be considered abandoned and may be archived or securely disposed of at Heritage Handover LLC's discretion.
9. Electronic Signature. The Client agrees that an electronic signature on this document is legally binding and equivalent to a handwritten signature.
